Has anyone beaten the ERISA irreversible pension law, and if so how? - pension law

I have a court order for my ex-wife, divorce is not received, a part of my pension, but the company now says that it provides no federal law that, if the pension divided that no changes can be made and I can not do all of my retirement.

Basically, you have to convince the society to try that the court is a Qualified Domestic Relations Order ( "QDRO"). A pension plan must comply with an appropriate ERISA QDRO. If there are technical deficiencies in the QDRO, the plan administrator said. You can then ask the Court for another order, which is a valid QDRO.

If a QDRO may change to a pension has begun is an area that is often confusion among administrators of pension plans, however, recent guidelines from the Department of Labor (available at http://www.dol.gov / EBSA / regs / fedreg / Fine. .. clearly shows that the court may amend a pension, even after payments have begun.
